It is proposed that our memory is made up of individual, unconnected Records, to each of which is attached a Heading. Retrieval of a Record can only be accomplished by addressing the attached Heading, the contents of which cannot itself be retrieved. Each Heading is made up of a mixture of content in more or less literal form and context, the latter including specification of environment and of internal states (e.g. drug states and mood). This view of memory allows an (...) easy account of a number of natural memory phenomena as well as a variety of laboratory findings such as the differences between recall and recognition. The theory further proposes that Headed Records can neither be deleted nor modified. Data apparently against such a hypothesis can be accounted for in terms of the retrieval process. (shrink)

My interest here is in the way Leo Strauss and his followers, the Straussians, have dealt with race and rights, race and slavery in the history of the United States. I want, first, to assess Leo Strauss's rather ambivalent attitude toward America and explore the various ways that his followers have in turn analyzed the Lockean underpinnings of the American “regime,” sometimes in contradistinction to Strauss's views on the topic. With that established, I turn to the account, particularly that offered (...) by Harry Jaffa, of how slavery and race comported—or did not—with the Straussian account of the political foundations of the new nation and how latter-day followers of Strauss have dealt with the persisting topic of race and racism in America. Overall, I want to make two large points. First, the Straussian commitment to superhistorical standards provides the Straussians with a moral perspective on slavery, race, and racism. Second, though race and slavery have been less than central among the concerns of most followers of Strauss, the contributions of Jaffa and others have significantly shaped the present American conservative position on race, including the idea of color-blindness. It is tempting to think that we have heard just about all we want or need to know about race. As the above quotes indicate, modern notions of race have always revolved around the faculty of vision, with supplementary contributions from other senses such as hearing, as Arendt notes in a tacit allusion to one mark of Jewish difference—the way they sounded when concentrated in urban settings. Yet two very recent works—Mark M. Smith's How Race Is Made and Anne C. (...) Rose's Psychology and Selfhood in the Segregated South —have much to teach us about how race has “worked”, particularly in the twentieth-century South but also, by implication, in the United States in general. Both works assume that, historically, race is no mere add-on to the self, a kind of externality that, once detected, can be relatively easily excised. Rather, it stands right at the heart of personal and group identity in a nation where race and ethnicity continue to assume surprising new shapes and forms. (shrink)

Public and professional debates have come to rely heavily on a special type of reasoning: the argument-from-ignorance, in which conclusions depend on the _lack_ of compelling information. "I win my argument," says the skillful advocate, "unless you can prove that I am wrong." This extraordinary gambit has been largely ignored in modern rhetorical and philosophical studies. Yet its broad force can be demonstrated by analogy with the modern legal system, where courts have long manipulated burdens of proof with skill and (...) subtlety. This legal, philosophical, and rhetorical study by Richard H. Gaskins provides the first systematic treatment of arguments-from-ignorance across a wide range of modern discourse—from constitutional law, scientific inquiry, and moral philosophy to organizational behavior, computer operation, and personal interaction. Neuroscientific scanning of meditators is taken as providing data on mystical experiences. However, problems concerning how the brain and consciousness are related cast doubts on whether any understanding of the content of meditative experiences is gained through the study of the brain. Whether neuroscience can study the subjective aspects of meditative experiences in general is also discussed. So too, whether current neuroscience can establish that there are “pure consciousness events” in mysticism is open to question. Hume's brilliant and dispassionate essay Of Miracles has been added in this expanded edition of his _Dialogues Concerning Natural Religion_, which also includes Of the Immortality of the Soul, Of Suicide, and Richard Popkin's illuminating Introduction.

It has become popular to portray the Buddhist Nāgārjuna as an ontological nihilist, i.e., that he denies the reality of entities and does not postulate any further reality. A reading of his works does show that he rejects the self-existent reality of entities, but it also shows that he accepts a "that-ness" to phenomenal reality that survives the denial of any distinct, self-contained entities. Thus, he is not a nihilist concerning what is real in the final analysis of things. How (...) Nāgārjuna’s positions impact contemporary discussions of ontological nihilism and deflationism in Western philosophy is also discussed. (shrink)

Scientific interest in drug-induced mystical experiences reemerged in the 1990s. This warrants reexamining the philosophical issues surrounding such studies: Do psychedelic drugs cause mystical experiences? Are drug-induced experiences the same in nature as other mystical experiences? Does the fact that mystical experiences can be induced by drugs invalidate or validate mystical cognitive claims? Those questions will be examined here. Public health is concerned with increasing the health of the community at whole. Insofar as health is a ‘good’ and the community constitutes a ‘public’, public health by definition promotes a ‘public good’. But ‘public good’ has a particular and much more narrow meaning in the economics literature, and some commentators have tried to limit the scope of public health to this more narrow meaning of a ‘public good’. While such a move makes the content of public health less controversial, (...) it also strips important goals from the realm of public health, goals that traditionally have been, and morally should be, a part of it. Instead, I will argue, while public health should be defined by public goods, it should be defined by a broader conception of public goods that I shall call ‘normative public goods’, goods that ought to be treated as if they were public goods in the more narrow sense. The purpose of this article is to expose a basic flaw at the root of perennialism as a method for studying mysticism—its distinction between ‘exoteric’ and ‘esoteric’ components of mysticism and religion. Rather than being distinct, the specific ‘exoteric’ doctrines of a given mystic’s tradition penetrate the mystics’ knowledge-claims. Thus, the ‘esoteric’ dimension in a mystical tradition is permeated by that mystical tradition’s ‘exoteric’ doctrines, not by the transcultural and ahistorical perennial spine that perennialists postulate. Contrary to what the perennialists (...) suggest, there is no one underlying esoteric set of beliefs embedded in all traditional religions that all mystics share. Rather, in the different religious traditions of the world, there are genuinely different mysticisms with different beliefs, practices, values, and goals. Thus, the perennialist approach distorts the history of mysticism. It is better seen as a theology of religions than as an alleged discernment of timeless truths presented throughout the history of mysticism. (shrink)

The most articulate among these intellectuals, who are themselves philosophers, are Bodunrin , Kwasi Wiredu , H. Odera Oruka , Marcien Towa and Eboussi Boulaga , and Paulin Hountondji . We explore why people feel the socially improper emotions of schadenfreude and gluckschmerz. One explanation follows from sentiment relations. Prior dislike leads to both schadenfreude and gluckschmerz. A second explanation relates to concerns over justice. Deserved misfortune is pleasing and undeserved good fortune is displeasing. A third explanation concerns appraisal of the good or bad fortunes of others as creating either benefit or harm for the self or in-group. Especially in competitive situations and when envy is present, gain is pleasing (...) and loss is displeasing. Both emotions have important implications for understanding human relations at the individual and group levels. (shrink)

According to a common judgement, a social planner should often use a lottery to decide which of two people should receive a good. This judgement undermines one of the best-known arguments for utilitarianism, due to John C. Harsanyi, and more generally undermines axiomatic arguments for utilitarianism and similar views. In this paper we ask which combinations of views about (a) the social planner’s attitude to risk and inequality, and (b) the subjects’ attitudes to risk are consistent with the aforementioned judgement. (...) We find that the class of combinations of views that can plausibly accommodate this judgement is quite limited. But one theory does better than others: the theory of chance-sensitive utility. Times of heightened risk to the physical safety of their citizens inevitably cause democracies to recalibrate their institutions and processes and to reinterpret existing legal norms, with greater emphasis on security, and less on individual liberty, than in "normal" times. This article explores the ways in which the American courts have responded to the tension between civil liberties and national security in times of crises. This history illustrates that courts have rejected both of the two polar positions that characterize public (...) discourse on these issues. Civil libertarians argue that political bodies are too easily gripped by passions, hysteria, and self-interest in these times and that courts therefore ought to play a central role in protecting liberty. Executive unilateralists argue that the qualities that uniquely characterize the executive branch, such as decisiveness, access to information, and efficiency, must become so dominant in these moments that few checks, if any, should constrain executive prerogatives. Oddly, civil libertarians and executive unilateralists find implicit consensus in the view that, in times of war, courts have tended not to play a significant role in overseeing executive power. We argue to the contrary: historically, a significant constitutional tradition of judicial scrutiny in the United States during times of war does exist. But this scrutiny does not take the form of courts making first-order substantive judgments about the content of liberty or other claimed constitutional rights. Nor does it take the form of judicial assessment of how significant or credible the national security claims of the executive branch might be. Instead, judicial oversight has been focused on preserving the institutional structures and processes through which decisionmaking on these issues takes place. The judicial role has centered on the second-order question of whether the right institutional processes have been used to make the decisions at issue, rather than on what the content of the underlying rights ought to be. This approach has historically rejected or resisted most claims of executive unilateralism. When courts have upheld the government's actions, they have done so only after a judgment that Congress, as well as the executive, has endorsed the action. This approach has also rejected the civil libertarian framework. When courts find bilateral institutional endorsement, they have typically accepted the joint political judgment of how liberty and security tradeoffs ought to be made. By focusing on congressional endorsement of emergency measures, the courts have created a broad-based political accountability for the actions taken in the name of national security. We suggest that even if congressional endorsement is more apparent than real in some of these contexts, the judicial maintenance of this structure of rhetorical justifications sustains desirable understandings of political structure. Because the President and Congress draw from different political constituencies in a presidential rather than a parliamentary system, we also raise questions about whether the American judicial approach to these questions should be limited to political systems with separated executive and legislative powers. There is but a mere hint of how atomistic philosophy was handled by the Aristotelians and to what extent they actually absorbed some of that tradition themselves. Nothing in detail is said of the process whereby atomistic and Platonic motives became coupled, not only by Bruno, (...) but by Ficino before and by Cudworth afterwards. On the credit side, however, the author does call attention to the commentary and paraphrase of Lucretius by Girolamo Frachetta of Rovigo (printed 1589), a work of some interest, which has been but little studied. Such rays of light are all too infrequent in this section and Papi is usually content to follow the conventional beaten path. For one to write a book on Bruno which breaks new ground is now difficult, for the field has been so thoroughly worked over. This one takes up a number of interesting themes found in Bruno's writings and sheds some light on them, but it seldom if ever says anything very different from the well-established tradition of Bruno scholarship in Italy which has produced so many mediocre books over the years. The specialist on Bruno and the sixteenth century will find little to detain him; the more casual reader could be ~rected to a number of superior treatments of various aspects of the Nolan's thought. Pp. 733. $19.50) This excellent study, the fruit of more than a dozen years of research, throws much light on Ralegh's thought and literary achievement. Lefranc has examined the manuscript sources, and unearthed quite a few new ones, and has patiently, carefully, and with much detective work, established what is no doubt the best available hypothesis of what is authentic among Ralegh's purported prose and poetic writings, and the date and circumstances of their composition. He has analyzed them in the context of Ralegh's carver, and has developed an exciting and rich interpretation of his political, philosophical and religious ideas. Ralegh's role in intellectual history derives mainly from his reputation as a Machiavellian, as an atheist, and from his mammoth, "pious," much-read providential History of the World (written during his years as a prisoner in the Tower of London). Lefranc deftly sorts and weighs the evidence for the various views and attitudes attributed to Ralegh in his own day and by interpreters ever since, and emerges from this examination with a fresh and striking picture of one of the liveliest bridge figures between the Elizabethan Renaissance and the modern world. The establishment of the canon leads to discarding as not by Ralegh many writings that have previously been used in interpreting the courtier's views. Three philosophical works which have played a role in twentieth-century interpretation, "A Treatise of the Soule," "The Prince, or Maxims of State" and "The Sceptick" are shown to be doubtful to a greater or lesser degree. "The Sceptick," which Strathmann (Sir Walter Ralegh,,4 Study in Elizabethan Skepticism, New York, 1951) had used to interpret Ralegh as a sceptical-Christian fideist, had been questioned earlier by Lefranc, Sprott, and myself. It is just a translation of portions of Book I of Sextus F_znpiricus' Outlinea of Pyrrhonism, and contains no connection with Ralegh, except that it was BOOK REVIEWS 213 published in his literary remains in 1651. Lefranc now, examining the evidence of the four manuscripts that have been discovered, concludes that it was a part of Ralegh's documentation when he was doing his research, but that 'Tattribution de 'The Sceptick' Ralegh lui-m~me ne repose sur rien" (p. 67). With the canon shorn of the dubious items, Lefranc proceeds to unfold a picture of Ralegh's intellectual world. Few people will easily admit to taking pleasure in the misfortunes of others. But who doesn't enjoy it when an arrogant but untalented contestant is humiliated on American Idol, or when the embarrassing vice of a self-righteous politician is exposed, or even when an envied friend suffers a small setback? The truth is that joy in someone else's pain--known by the German word schadenfreude--permeates our society. In The Joy of Pain, psychologist Richard Smith, one of the world's foremost authorities (...) on envy and shame, sheds much light on a feeling we dare not admit. Smith argues that schadenfreude is a natural human emotion, one worth taking a closer look at, as it reveals much about who we are as human beings. We have a passion for justice. Sometimes, schadenfreude can feel like getting one's revenge, when the suffering person has previously harmed us. But most of us are also motivated to feel good about ourselves, Smith notes, and look for ways to maintain a positive sense of self. One common way to do this is to compare ourselves to others and find areas where we are better. Similarly, the downfall of others--especially when they have seemed superior to us--can lead to a boost in our self-esteem, a lessening of feelings of inferiority. This is often at the root of schadenfreude. As the author points out, most instances of schadenfreude are harmless, on par with the pleasures of light gossip. ‘The work of the philosopher consists in assembling reminders for particular purposes.’ Among the many purposes for which Wittgenstein assembled reminders, the deeper understanding of the religious life would have to qualify as one. Though on first reading this would hardly seem obvious, I hope to make this abundantly clear through an examination of his later literature. There are two ways in which he sheds light on religious issues: first , by the personal passion of his own life and the (...) forthright display of intellectual integrity expected of any professional thinker toward any discipline , and, second , by making his philosophical investigations descriptive. Any analysis of religious issues or the understanding of the religious life should involve the high degree of personal integrity and the rigorously descriptive method which Wittgenstein makes apparent throughout his writing.
